New Complaints Act: whistleblowing

Businesses With 250 Or More Employees Will Be Required To Comply With The Complaints Act From The 24th Of July 2023, And Businesses With 50 Or More Employees From 17 December 2023.

On the 24th of July 2023, the new Complaints Act (Act XXV of 2023 on Complaints, Notifications of Public Interest and Rules on Reporting Abuses) entered into force, which ensures compliance with Directive (EU) 2019/1937. While the similar legislation previously covered mainly complaints about the work of public entities, from now on, an independent internal procedure for reporting abuse must be established for a significant number of businesses.

  • Businesses with 250 or more employees will be required to comply with the Complaints Act from the 24th of July 2023
  • Businesses with 50 or more employees from 17 December 2023.

This will require an internal whistleblowing system to be established to ensure that current, former and prospective employees and subcontractors can report any unlawful or suspected unlawful act, omission or other information about abuse.
